    The 2005 Cumulative Supplement to Computer and Intellectual Property Crime: Federal and State Law includes the following new discussions and updates:

  • A complete revision of Chapter 12, which describes the federal identity theft and fraud statutes. By legislation passed in 2003 and 2004, Congress created three new offenses relating to the wrongful use, transfer and possession of personal identification information, and devices that are used to ensure that identification documents are genuine. Penalties for many identity theft offenses were also increased.

  • A substantial revision to Chapter 11, which deals with counterfeit and illicit labels and counterfeit documentation and packaging. In 2004 legislative amendments to the counterfeit labels statute, Congress significantly expanded the scope of the statute’s coverage in two ways. First, the statute was expanded to cover use of “illicit” labels, in addition to counterfeit labels. Second, the protection of the statue was expanded to cover new types of copyrightable material, including literary, pictorial, graphical, and sculptural works and works of visual art. Discussion of these revisions has been included in the supplement to the chapter. Updates to Chapters 9 and 10, dealing with the criminal trademark and copyright laws, concerning the case law and prosecutorial developments affecting those key intellectual property crime statutes during 2004. Significant case-law updates to Chapter 15, which deals with the child pornography statutes. These updates reflect case law developments in reaction to 2003 legislation in this area, and the large numbers of pornography cases brought by federal and state authorities.
